A Magistrates court has declined to review its own decision that allowed the detainment of two people allegedly arrested with hand grenades outside the residence of businessman Jimmy Wanjigi’s house in Muthaiga.
In dismissing the application, Chief Magistrate Bernard Ochoi said the court cannot sit on its own decision but instead asked the parties to consider an appeal if dissatisfied with his decision.
He said the application made by Advocate Willis Otieno was not justified.
Ochoi on Monday allowed the police to detain Dancan Otieno and Calvin Odongo for seven days pending further investigations.
This was after they were arrested in a black Toyota Prado allegedly containing hand grenades just right outside Wanjigis Muthaiga premises.
The DCI had asked for 14 but the court reduced it by half saying it was excessive.
Ochoi in allowing the DCI application said it is necessary to have the suspects remanded going by the nature of their arrest.
He also said that their identity needs to be confirmed before they can be released.
But shortly after, Otieno rose on his feet and asked the court to review his decision.
He told the court that the persons who planted the explosives in the vehicle are police officers.
He mentioned that CCTV cameras are capturing what transpired.
“Allow the innocent to get out of the fight and let the giants fight like giants,” he said.
He said the suspects had already spent more than five days from when they were arrested and that verification of their identity can be done when they are not in custody.
But Ochoi said the same is not a ground for review but for appeal.
The two suspects will remain at Central Police Station until the seven days which started on Monday lapse.
