Rongo Success Academy in Migori county has made good its threat and sued Nation Media Group television channel NTV over a story the institution claims was defamatory.
NTV ran a news segment on April 7 in which it allegedly claimed that several learners from the school had been lost to weird Christian teachings.
The news also allegedly claimed that some teachers admitted to the allegations and that five students had disappeared and reappeared multiple times.
The school had given the station seven days to apologise failing which it would institute civil proceedings against the media house.
On Monday, Rongo Success Academy and its director Eliud Ondeyo Kondeyo filed a suit at the Milimani commercial magistrate court seeking orders to refrain Nation Media Group from publishing or broadcasting any information relating to them.
Through lawyer Danstan Omari, the duo claim that the April 7 broadcast destroyed their standing and reputation among right-thinking members of the society.
Magistrate Eunice Mutie on Thursday directed that the respondent be served with the application within three days after which they will have another seven days to respond.
The matter has been set for inter parte hearing on June 21.
