The High Court has stopped the printing of ballot papers and elections for the position of Law Society of Kenya-Nairobi Representative.
Justice John Chigiti issued the order pending the hearing and determination of a case filed by City Advocate Victor Khayesi Mulindi.
The elections for the said position had been slated for February 29.
Mulindi’s application before the court follows after receiving an email from the secretary of the Ad Hoc elections board Dr Owiso Owiso.
Owiso in the email communicated the decision of the board that found him not validly nominated to contest for the position of Nairobi representative in the 2024 LSK Council elections.
He explains that his nomination was invalidated because his nominators Orina Kerubo and Betty Wanjiku were admitted to the bar on December 2 last year and 12 February respectively.
The two according to the papers have not practiced for at least two years from the date of admission.
It’s based on this ground, that Mulindi did not qualify to be elected to the position of Nairobi representative.
He appealed this decision but the board dismissed it.
“The board’s decision invalidating my nomination by Kerubo and Wanjiku is unfair and is influenced by irrelevant considerations,” he said.
He says the two are respected members of LSK and in active practice.
Those sued are the Law Society of Kenya and the Ad Hoc Elections Board 2024.
The Judge directed once responses are filed, the matter be mentioned on February 26 to secure a date for judgment.
