DPP Haji: I didn’t order arrest of Judges Muchelule and Chitembwe

The Director of Public Prosecution Noordin Haji has refuted claims he ordered the arrest and questioning of High Court judges Aggrey Muchelule and Said Chitembwe.

In a statement on Thursday, the DPP said he was not aware of the reason leading to their arrests and questioning, and that his office had not received any files concerning them.

“Contrary to reports by one Eric Theuri, purportedly speaking for LSK blaming the DPP for the arrest, the DPP is not aware of circumstances which led to arrest or questioning of 2 Judges,” Haji said.

He added that in the event their files are presented to his office for advice, he will direct as is appropriate.

The two judges were accused of receiving bribes for various cases they previously handled.

Also quizzed were their drivers and clerks before they were released at about 5pm.

The Law Society of Kenya in a statement condemned the move, terming it efforts by the executive to claw back the gains made on the independence of the judiciary.

LSK president Nelson Havi said the arrest was intended to demoralise the judges and also undermine the judiciary.

“It should not be lost to Kenyans that Justice Muchelule is one of the six judges who have not been sworn-in office,” Havi said.

He added, “Justice Chitembwe has been pulled into the nefarious scheme by the executive.”

LSK demanded an apology from the executive or the resignation of DCI George Kinoti, adding that a similar occurrence should not happen.
